REGULATIONS OF THE GOVERNOR ADMINISTRATION OF VILNIUS COUNTY I. GENERAL REGULATIONS 1. The governor administration of Vilnius County (further referred as “County Administration”) is a public office, which is formed by the County Governor to exercise the assigned functions. 2.County Administration in its activities follows the law on the of Governing of the County of Lithuanian Republic, the law of Lithuanian Republic for Regional Development, these regulations and other legal acts of the Republic of Lithuania. 3. Vilnius County Administration is public legal person with an account in a bank and a seal containing the state emblem of the Republic of Lithuania and the name of the county. 4. County Administration has its own County symbols. 5. Vilnius County Administration is financed by the State Budget of the Republic of Lithuania. 6. The office of County Administration is under the address: 14 Gedimino Ave., Vilnius. II. THE STRUCTURE OF COUNTY ADMINISTRATION 7. The structure of County Administration shall be approved by the county governor following the standard structure of County Governor’s Administration approved by the Government of the Republic of Lithuania. 8. County Administration consists of departments, divisions, inspections, and services (structural subdivisions). 9. The structural subdivisions of County Administration shall organize their work following the regulations of structural subdivisions approved by the order of the county governor and the heads of subdivisions and public officials shall follow function descriptions prepared and approved by the county governor according to the regulations of the Public Service Law of the Republic of Lithuania. III.THE FUNCTIONS OF COUNTY ADMINISTRATION 10. County Administration while discharging the functions attributed by the law to the county governor shall: in the Spheres of Education, Culture and Social Welfare: 10.1.1 prepare documents by necessity in the manner prescribed by law, to establish, reorganise, and liquidate state institutions and establishments of education (except High Schools),culture, physical culture and sports, social assistance and care and special institutions of social services lying within the county; 10.1.2 ensure the functioning and maintenance of state institutions referred to in the item 10.1.1 of these Regulations; 10.1.3 prepare documents, approving the establishment, reorganization and liquidation of county independent and municipality institutions of preschool, complementary development and non-formal adult education; 10.1.4 organize certification of the heads and educators of state educational institutions lying within the county; 10.1.5 assemble the register data of educators and students of the county educational institutions and analyze the information about educational, social and cultural state in the county; 10.1.6 help the county governor to supervise the implementation of general state education, cultural and social policy in the county; 10.1.7 supervise the running of the records of preschool children in municipalities, ensuring that all under 16 year old children living in the area of the county attend school and caring for the protection of children rights; 10.1.8 provide the county governor with the information necessary to account to the Government of the Republic and to the established manner, to the authorized institution, about the provision and quality of the social services in the social service providing institutions liable to the county, and prepare him the due documentation; 10.1.9 following the governor’s assignment in conjunction with territorial labour exchanges, resolve employment and social integration problems of the population; 10.1.10 care about implementation of education, culture, social physical culture and sport state programs in the county, organize county sport competitions maintained by the finances of the state; 10.1.11 arrange programs for culture, physical culture and sport development in the county and their implementation; 10.1.12 considering the suggestions by the Regional Development Council, plan tourism development in the area of the county; 10.2 in the Sphere of Health Care: 10.2.1 inform the county governor about the implementation of the state health strategies and health service reform approved by the Government of The Republic of Lithuania in the county; 10.2.2 arrange necessary documentation for the county governor to analyze the health condition and changes of the population of the municipalities, and recommendations (to the Government of the Republic of Lithuania and the Ministry of Health) agreed by the county municipalities, concerning the maintenance, recovery and development of the health of the county residents; 10.2.3 prepare documents necessary to establish, reorganize and liquidate the hospitals under the county and also secondary health care specialized institutional personal care facilities stated and included into the list approved by the Ministry of Health; 10.2.4 help to organize the implementation of compulsory state health programs in the county, preparation and implementation of the programs for regional public health education and incommunicable diseases and traumas prevention; 10.2.5 cooperate with the county municipalities in formatting and organizing the health councils of municipality communities and analyze their activities. 10.2.6 provide recommendations to the county governor about the necessary to arrange documentation to declare the territory of the county or its part the zone hazardous or harmful to health; 10.3 in the Spheres of Territorial Planning and Monument Conservation: 10.3.1 help to organize the preparation of territorial planning documents on the county level, participate in the procedure of co-ordination; 10.3.2 help the county governor to assemble and manage data bank of territorial planning and the register of territorial planning data, as well as furnish information to data banks of other levels; 10.3.3 prepare documentation for the county governor, necessary to the established manner, furnishing information, findings and recommendations for the preparation of general and special plans of the territory of the Republic of Lithuania; 10.3.4 prepare information for the county governor, necessary to prepare conditions for the territorial planning documents in the County and Municipalities; 10.3.5 within its competence perform state supervision of municipality territorial planning, structures design, construction, acceptance of structures appropriate to use, evaluation of the emergency state of structures and destruction; 10.3.6 help the county governor to supervise territorial planning; 10.3.7 within its competence issue construction licences (except those assigned by law for the Mayor to issue), keep records of construction licences and statistic liability, perform independent prevention of constructions, make decisions concerning the elimination of their consequences; 10.3.8 discharge other functions, appointed by the laws of construction; 10.3.9 help the county governor to coordinate the actions of municipalities and state institutions performing works of geodesy, topography and geoinformatics and in the prescribed manner perform the state supervision of these works; 10.3.10 prepare documents necessary to perform the protection of cultural valuables and monuments, manage record documentation of cultural valuables and monuments and supervise monument conservation; 10.4 in the Spheres of Land Use Planning and Agriculture: 10.4.1 prepare documents necessary to mange free state land stock, with the exception of land transferred into the possession of the institutions of local authorities; 10.4.2 help the county Governor to implement land reform; 10.4.3 prepare documents necessary to assume land servitudes, help to perform state regulation of land use, as well as state control of land use; 10.4.4 assigned by the county governor carry out state maintenance of land reclamation and hydro technical equipment; 10.4.5 prepare documents by necessity for selling or in any other way transfer state land to private property, except the pieces of land prescribed for the objects of real property under privatization, assigned by the county governor represent the state when private land is transferred to state property, when the state prescribed by law takes over or by a testament inherits land; 10.4.6 prepare decision projects by necessity to take land for public demands, as well as the questions concerning the change of the main objective purpose of land use; 10.4.7 coordinate, organize and implement the programs of the regional development of the country; 10.4.8 perform state land use planning works; 10.5 in the Spheres of the Utilisation of Natural Resources and Environmental Protection: 10.5.1 develop state programs of Environmental Protection for the county, documents foe the investment projects, organize and coordinate the implementation of such programs and projects; 10.5.2 prepare documents concerning the activities prescribed by law acts in protected territories attributed to the county and participation in the management of other protected territories ( with the exception of nature reserves); 10.5.3 prepare the information for the county governor necessary in the prescribed manner, to give recommendations for the determination of the utilisation limits of natural resources; 10.5.4 coordinate the collection of recycling materials and maintenance of utility waste, prepare documents necessary to intend land areas for keeping utility and dangerous waste; 10.5.5 in the prescribed manner by the county governor, coordinate the maintenance of protected zones of water bodies and protected strips of riversides and coasts, as well as the management of water bodies; 10.5.6 organize hunting examinations, the commission work when giving and abolishing rights, issue the licences of hunters, approve the lists of hunters, keep the records of the hunters independent from hunters’ assossiations; 10.5.7 help the county governor to exercise state control over the condition, utilisation, recreation and protection of forest; 10.5.8 help the county governor to organise ecological education; 10.6 in the Sphere of Civil Security: 10.6 1 prepare documents to develop the plan on readiness of county civil security for extreme situations, warn state and municipality institutions, economy entities, and citizens about the danger of extreme situation, inform about its nature and possible extend; 10.6.2 assemble information from all the municipalities of the county necessary to exercise the tasks of civil security; 10.6.3 help to organize and perform prevention means of civil security in case of extreme situations within the territory of the county; 10.6.4 assemble and submit to the Department of Civil Security under the Ministry of National Defence the information about extreme events happened in the county 10.6.5 following the county governor’s appointment, organize liquidation of the consequences of extreme events, searching and rescue works and their supply, coordinate the actions of county municipalities in organizing the liquidation of the consequences of extreme events; 10.6.6 assemble the material to help the casualties of the extreme events; 10.6.7 develop the application projects to the Government of the Republic of Lithuania in case of extreme situations when there is not enough forces and supplies; 10.6.8 prepare annual analysis of the state of readiness of civil security for extreme situations and submit it to the Department of Civil Security under the Ministry of National Defence; 10.6.9 train society of practical actions for extreme situations; 10.6.10 submit methodological help concerning the questions of civil security to municipalities, structural subdivisions of ministries and Government institutions, economy entities and services; 10.6.11 assemble register data base of the state importance and dangerous objects within the territory of the county, save data copies and in the established manner allow other institutions to use it, submit such information to the Sate register of dangerous objects; 10.7 in the Sphere Regional Development: 10.7.1 perform the functions of the secretariat of the council of regional development; 10.7.2 develop and participate in the development of the projects on regional development; 10.7.3 organize the supervision and evaluation of the implementation of regional development plans; 10.7.4 provide with methodological support in developing project proposals of local initiatives; 10.7.5 ensure cooperation with municipalities and social economical partners while establishing development plans, programs and implementation projects; 10.7.6 perform functions related with the receipt and use of the support from the funds of joining the European Union, if the county is supported from the funds hereinbefore; 10.7.7 perform other functions prescribed by laws and regulations of regional development institution; 10.8 in other Spheres: 10.8.1 consider applications and requests of natural and legal persons and give recommendations for the county governor to adopt decisions with regard to them; 10.8.2 provide the information to the county governor necessary to analyze the social, economic, and ecological condition of the county and changes in it, and inform the population thereof; 10.8.3 prepare documents by necessity to register non-government organisations, the activities of which embrace the territory of more than one municipality and the registered office of which is located in the county centre or in another territory of the county, which is in the urban or rural territory, as well as approve their statutes; 10.8.4 prepare documents necessary to establish, reorganize and liquidate sate institutions; 10.8.5 cooperate with municipalities and state institutions as well as enterprises and organizations subordinate to them; 10.8.6 help the county governor to monitor the implementation of the state programs on means of safe traffic in the whole territory of the county; 10.8.7 within its competence exercise mobilization and the training of the mobilization reserve; 10.8.8 exercise other functions prescribed by laws, decisions of the Government of the Republic of Lithuania and the county governor. IV. THE RIGHTS OF COUNTY ADMINISTRATION 11. County Administration shall have the rights: to receive information from other state governing institutions and county municipalities, enterprises, institutions and organisations on issues that are within its competence; within its competence, in extreme case, take additional measures to ensure the security of the population and their property and to maintain order in the county; following the county governor’s assignment, form expert commissions for the purpose of analysing the issues attributed to administration’s competence and for providing the findings thereon; within its competence maintain the relationships with the appropriate institutions of foreign states and international organizations. V. ORGANIZATION OF THE WORK OF COUNTY ADMINISTRATION 12. County Administration is headed by the county governor, who is appointed and dismissed from office by the Government of the republic of Lithuania upon the recommendation of the Prime Minister. 13. The county governor shall: organise the work of the Administration and be responsible for its activities; issue orders and other legal acts approved by orders and oversee their enforcement. The orders and other legal acts of the county governor shall be binding upon County Administration and subordinate institutions and organizations; as prescribed by the Law on Public Service of the Republic of Lithuania appoint and dismiss from office the county secretary, chief executives of Administration departments, divisions and other subdivisions and heads of institutions subordinate to him; approve the structure of County Administration and the regulations (statutes) of structural subdivisions and institutions subordinate or appointed to him; submit to the Government of the Republic of Lithuania the draft revenue and expenditure plan of the county; within the limits of the set wages fund, approve the payroll of the administration; convene the first session of the Council for Regional Development and conduct the work of the Council until the chairperson is chosen and regulations are approved by the Council; coordinate the activities of administrative subdivisions directly or through deputy and the county secretary – an assistant of the head of the institution, and of subordinate institutions and organizations through heads of such institutions; exercise other powers vested him by legal acts. 14. The county governor shall have two deputies, who shall be appointed and dismissed from the office by the Government of the Republic of Lithuania upon the recommendation of the Prime Minister. They shall be responsible for the performance of the prescribed functions and accountable to the county governor; 15. Deputies county governors perform the prescribed functions by the county governor and in the absence of the county governor, shall carry out the duties of the county governor. 16. The activities of County Administration shall be organized following the declared Strategic Activity Plans, where the main aims of the county governor and ways of their implementation are described. The Strategic Activity Plans of the County shall be developed for the periods of three, five and ten years in consideration to the Long-term Strategic Activity Plan of the Government of the republic of Lithuania (previously approved by the Ministry of the Interior). The implementation of the planned facilities in the Strategic Activity Plans shall be controlled by the county governor and deputies. 17. Current questions on the activities of County Administration shall be discussed at the meeting organised by the county governor and participated by the county governor deputies, county secretary and chief executives of structural subdivisions. If required other public officials shall be invited to the meeting. VI. REFORM, REORGANIZATION AND LIQUIDATION OF COUNTY ADMINISTRATION 18. County Administration shall be reformed, reorganized and liquidate in the manner established by law. ______________________________________
